1. Definitions
Throughout these Terms: • Film Industry Gateway, FIG, we, our and us refer to Film Industry Gateway. • Platform refers to the Film Industry Gateway website, applications, software, databases and services. • User refers to any person accessing or using the platform. • Filmmaker refers to any user creating projects, content or listings. • Sponsor refers to any business, organisation or individual providing support to projects. • Project refers to any film, series, documentary, animation, commercial or creative production listed on the platform. • Content refers to any information, files, text, images, videos, messages, comments or materials uploaded to the platform.
2. Eligibility
You must be at least 18 years old to create an account. If you are under 18, you may only use the platform with permission from a parent or legal guardian. By using Film Industry Gateway, you confirm that you have the legal capacity to enter into these Terms.
3. Account Registration
To access certain features, users must create an account. You agree to:
- Provide accurate information
- Keep your information updated
- Maintain the security of your account
- Protect your login credentials
- Accept responsibility for activity conducted through your account
You are responsible for all activity occurring under your account.
4. Account Types
Film Industry Gateway may offer different account types including:
- Free Filmmaker Accounts
- Free Sponsor Accounts
- FIG Pro Accounts
- FIG Studio Accounts
- Coaching Members
- Business Accounts
- Administrator Accounts
Features may vary between account types. Film Industry Gateway may add, remove or modify account types in the future.
5. User Conduct
Users agree not to:
- Violate laws or regulations
- Infringe intellectual property rights
- Upload malicious software
- Attempt unauthorised access
- Harass other users
- Post unlawful content
- Impersonate others
- Commit fraud
- Circumvent platform systems
- Disrupt platform functionality
We reserve the right to suspend or terminate accounts that violate these Terms.
6. User Content Ownership
Users retain ownership of the content they upload. This includes:
- Scripts
- Concepts
- Film projects
- Images
- Videos
- Documents
- Resources
- Uploaded files
Film Industry Gateway does not claim ownership of user-created intellectual property.
7. Licence Granted To Film Industry Gateway
By uploading content, you grant Film Industry Gateway a limited licence to:
- Store content
- Display content according to your settings
- Process content
- Back up content
- Deliver platform services
This licence exists solely for the purpose of operating the platform.
8. Public Content
Users are responsible for deciding what information is made public. Public content may include:
- Public project listings
- Sponsor Marketplace listings
- Public profiles
- Festival reviews
- Community comments
Information marked as public may be viewed by other users.
9. Private Content
Film Industry Gateway will treat private content as private where technically possible. Examples include:
- Team Hub communications
- Private projects
- Coaching messages
- Private files
- Internal notes
However, users acknowledge that no system can guarantee absolute security.
10. Project Ownership
The creator of a project is considered the Project Owner unless ownership is transferred. Project Owners may:
- Edit projects
- Delete projects
- Transfer ownership
- Manage team permissions
- Control project visibility
Film Industry Gateway does not determine ownership disputes between users. Users are responsible for resolving ownership disagreements independently.
11. Team Hub
Film Industry Gateway provides Team Hub communication features. Project Owners and Project Administrators are responsible for managing team members, permissions, channels and access controls. Users are responsible for content shared within Team Hub spaces.
12. Sponsor Marketplace
Film Industry Gateway provides tools allowing sponsors and filmmakers to connect. Film Industry Gateway is not a party to sponsorship agreements. Any sponsorship arrangement is entered into directly between users.
13. Sponsorship Responsibility
Sponsors and filmmakers are solely responsible for:
- Negotiating sponsorship arrangements
- Deliverables
- Expectations
- Agreements
- Payments where applicable
- Compliance with laws
Film Industry Gateway does not guarantee sponsorship outcomes.
14. Sponsor Marketplace Fees
Film Industry Gateway may charge fees in connection with Sponsor Marketplace transactions. Current fees, if any, will be disclosed within the platform. Fees may change in the future.
15. Donations
Users may choose to financially support projects through donation features. Donations are voluntary. Film Industry Gateway does not guarantee project completion or outcomes resulting from donations.
16. Investment Disclaimer
Film Industry Gateway is not a licensed financial adviser. The platform does not provide financial advice. Users are responsible for obtaining independent professional advice regarding investments. Any investment discussions occurring between users are conducted at their own risk.
17. Festival Database
Film Industry Gateway may provide festival information, recommendations and user-generated reviews. Users are responsible for independently verifying submission deadlines, entry requirements, fees and eligibility criteria. Film Industry Gateway does not guarantee the accuracy of festival information.
18. Job Listings
Film Industry Gateway may provide job listing features. Users are solely responsible for job postings, applications, hiring decisions, employment arrangements and payments. Film Industry Gateway does not guarantee job opportunities or employment outcomes.
19. Courses And Educational Content
Film Industry Gateway provides educational materials for informational purposes only. We do not guarantee career outcomes, festival success, funding success, employment outcomes or commercial success. Success depends on many factors beyond the platform.
20. Coaching Services
Coaching services provide guidance, support and education. Coaching does not constitute legal advice, financial advice, tax advice or investment advice. Users remain responsible for their own decisions and projects.
21. AI Features
Film Industry Gateway may provide AI-powered tools. AI-generated outputs may contain errors, may be incomplete and should be independently reviewed. Users are responsible for verifying information generated through AI features. Film Industry Gateway does not guarantee the accuracy of AI-generated content.
22. Readiness Reports
Readiness Reports are guidance tools intended to assist users in evaluating projects. They are not guarantees of funding success, production success, distribution success or festival acceptance. Users remain responsible for all project decisions.
23. Availability Of Service
We aim to provide reliable services but cannot guarantee uninterrupted operation. The platform may experience maintenance, downtime, technical issues and feature changes. We may modify, suspend or discontinue features at any time.
24. Subscription Services
Certain features require paid subscriptions. Current plans may include FIG Pro, FIG Studio and Coaching Services. Prices and features may change over time. Reasonable notice will be provided where possible.
25. Billing
Paid subscriptions are billed according to the selected plan. By subscribing, users authorise recurring charges where applicable. Users are responsible for maintaining valid payment information.
26. Subscription Changes
Users may upgrade, downgrade, pause or cancel subject to platform policies and payment provider requirements.
27. Refunds
Unless required by law, subscription payments are generally non-refundable. Refund requests may be considered on a case-by-case basis. Nothing in these Terms excludes rights available under Australian Consumer Law.
28. Account Suspension
Film Industry Gateway may suspend accounts that violate these Terms, create security risks, engage in abuse or engage in fraudulent behaviour. Suspensions may be temporary or permanent.
29. Account Termination
We may terminate accounts where necessary. Users may also delete their accounts through platform settings. Termination does not automatically remove all historical records where retention is legally or operationally required.
30. Deleted Projects
Users may delete projects according to platform functionality. Deleted projects may remain recoverable for a limited period before permanent deletion. Film Industry Gateway reserves the right to retain deletion logs for operational and security purposes.
31. Intellectual Property
Film Industry Gateway owns its platform branding, logos, software, designs, educational materials, platform code and original platform content. Users may not reproduce or distribute Film Industry Gateway intellectual property without permission.
32. Copyright Complaints
If you believe content infringes your copyright, please contact adon@filmindustrygateway.net with a description of the work, a description of the infringement, your contact details and supporting information.
33. Third-Party Services
Film Industry Gateway may integrate with third-party services including FilmFreeway, payment providers, email providers, analytics providers and cloud services. We are not responsible for third-party services. Users should review third-party terms separately.
34. Limitation Of Liability
To the maximum extent permitted by law, Film Industry Gateway is not liable for lost profits, lost opportunities, lost data, business interruption, project failure, festival rejection, sponsorship disputes, funding outcomes or user conduct. Use of the platform is at your own risk.
35. Indemnity
Users agree to indemnify Film Industry Gateway against claims arising from user content, user conduct, violations of these Terms, violations of law and intellectual property disputes.
36. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies rights that cannot legally be excluded under Australian Consumer Law.
37. Changes To These Terms
We may update these Terms from time to time. Updated versions will be published on the platform. Continued use of the platform after changes constitutes acceptance of the revised Terms.
38. Governing Law
These Terms are governed by the laws of Western Australia and Australia. Any disputes shall be subject to the jurisdiction of the courts of Western Australia unless otherwise required by law.
